Introduction

These Terms and Conditions (“Terms”) govern your use of the Doncaster Auction Centre Ltd (“DAC”, “we”, “us”, “our”) website and all services provided by DAC, including but not limited to auction sales, house clearance services, and probate valuations. By accessing our website or using our services, you agree to be bound by these Terms.

Definitions

  • “Bidder” means any person or entity who registers to bid at a DAC auction
  • “Buyer” means the highest bidder accepted by the auctioneer
  • “Seller” / “Vendor” means any person or entity who consigns goods for sale at auction
  • “Lot” means any item or group of items offered for sale
  • “Hammer Price” means the final bid price accepted by the auctioneer
  • “Buyer’s Premium” means any additional charge payable by the buyer on top of the hammer price

Auction Conditions of Sale

Registration

All bidders must register before participating in any auction. Proof of identity and address may be required. By registering, you agree to these Terms and accept personal liability for any bids placed.

Bidding

All bids are binding. The auctioneer has absolute discretion to refuse any bid, withdraw any lot, or re-offer a lot for sale. The auctioneer acts as agent for the seller. Bidding increments are at the discretion of the auctioneer.

Payment

Payment is due in full on the day of sale unless alternative arrangements have been agreed in writing. We accept cash, debit cards, and bank transfer. Goods remain the property of DAC until payment has been received in full.

Collection

All lots must be collected by the buyer on the day of sale or within the agreed collection period. DAC accepts no responsibility for items left after the stated collection deadline. Storage charges may apply for uncollected items.

Condition of Lots

All lots are sold as seen. Descriptions are provided in good faith but do not constitute a guarantee or warranty. Buyers are strongly encouraged to attend the pre-sale viewing day to inspect lots prior to bidding. DAC shall not be liable for any errors in descriptions or catalogue entries.

Returns & Refunds

As all lots are sold as seen at auction, returns and refunds are generally not offered. In exceptional circumstances (e.g., significantly misleading description), matters will be dealt with at the discretion of DAC management.

Seller Conditions

Consignment

By consigning goods for sale, the seller warrants that they are the legal owner (or authorised agent) and have the right to sell the items. DAC reserves the right to refuse any item for consignment at its sole discretion.

Commission

DAC charges a seller’s commission on the hammer price of each lot sold. The commission rate will be agreed prior to consignment. DAC may also charge for additional services including photography, insurance, and specialist handling where applicable.

Unsold Lots

Lots that do not meet their reserve (if set) or fail to attract bids will be returned to the seller or re-entered in a future auction at DAC’s discretion. Collection or re-entry terms will be agreed in advance.

House Clearance Services

Where DAC provides house clearance services, a written quotation will be provided before work commences. The quotation is valid for 30 days unless otherwise stated. Any items identified as having auction value may be consigned for sale, with proceeds (net of commission) returned to the client.

Probate & Valuation Services

DAC provides estate valuations for probate purposes. All valuations are given in good faith based on our professional experience and current market conditions. Valuations are for guidance and probate purposes only and do not constitute a guarantee of sale price.

Limitation of Liability

To the fullest extent permitted by law:

  • DAC shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services
  • DAC’s total liability in respect of any claim shall not exceed the hammer price of the lot(s) in question
  • DAC shall not be liable for any loss or damage to lots while in our custody except where caused by our negligence
  • DAC shall not be liable for any failure or delay in performance caused by circumstances beyond our reasonable control (force majeure)

Intellectual Property

All content on our website — including text, images, logos, and design — is owned by or licensed to DAC and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or use any content without our prior written consent.

Website Use

You agree to use our website only for lawful purposes. You must not use our website in any way that could damage, disable, or impair the site, or interfere with any other party’s use of the website. We reserve the right to restrict or terminate access at any time.

Third-Party Links

Our website may contain links to third-party websites (e.g., EasyLiveAuction). We are not responsible for the content, accuracy, or practices of any third-party sites. Accessing third-party links is at your own risk.

Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Amendments

DAC reserves the right to amend these Terms at any time. Changes will be effective immediately upon posting to our website. Continued use of our services constitutes acceptance of any amended Terms.
